Homebase is a service provided by Mighty Jo LLC, and is part of the Illumination + Inspiration family of products. These terms govern your use of Homebase. By using our platform, you agree to these terms. We've tried to keep them clear and fair.

Using Homebase

You may use Homebase if you:

Are at least 18 years old or have parental consent
Provide accurate information when creating your account
Keep your login credentials secure
Use the platform for lawful purposes only

Your Content

You retain ownership of all content you create on Homebase, including your children's profiles, activities, and portfolio items. We don't claim any ownership rights to your content. You grant us a limited license to store, display, and process your content solely to provide our services to you.

Free and Paid Services

Homebase offers both free and paid features. Free accounts have access to core functionality. Paid subscriptions unlock additional features and storage. We'll always be clear about what's free and what requires payment.

IMPORTANT: Third-Party Provider Disclaimer

HOMEBASE IS A LISTING PLATFORM ONLY. We provide a directory service that allows third-party activity providers, instructors, organizations, and businesses ("Providers") to list their services, programs, and activities. Homebase does not own, operate, manage, or control any Provider or their activities.

NO AFFILIATION OR ENDORSEMENT: The inclusion of any Provider on Homebase does not constitute an endorsement, recommendation, certification, or approval by Homebase, Mighty Jo LLC, or Illumination + Inspiration. We do not verify, investigate, or guarantee the qualifications, credentials, background, safety practices, or suitability of any Provider.

NO VETTING OR BACKGROUND CHECKS: Homebase does not conduct background checks, criminal history screenings, reference checks, credential verifications, or any other vetting procedures on Providers or their staff, employees, contractors, or volunteers. Providers are solely responsible for their own hiring and safety practices.

USER RESPONSIBILITY: You are solely responsible for conducting your own due diligence before engaging with any Provider. This includes, but is not limited to, verifying credentials, checking references, conducting background checks, reviewing safety policies, and making informed decisions about the suitability of any Provider for your family.

Provider Verification Badges

WHAT "VERIFIED" MEANS: Some Providers on Homebase may display a "Verified" badge. This badge indicates ONLY that the Provider has completed one of the following verification processes:

Identity Verification: The individual has submitted a government-issued ID and selfie that have been verified through our third-party identity verification service (Stripe Identity).
Document Verification: The organization has submitted business documentation (such as a business license, 501(c)(3) determination letter, or insurance certificate) that has been reviewed by our team.

WHAT "VERIFIED" DOES NOT MEAN: A "Verified" badge does NOT indicate:

A criminal background check has been conducted
References have been checked
Professional credentials or qualifications have been verified
Safety practices or policies have been reviewed
The Provider is endorsed, recommended, or approved by Homebase
The Provider's staff, employees, or volunteers have been screened
The quality of services provided has been evaluated

YOUR RESPONSIBILITY: Regardless of whether a Provider displays a "Verified" badge, you remain solely responsible for conducting your own due diligence, including background checks, reference checks, and evaluation of any Provider before engaging their services for your family.

Provider Relationships & Assumption of Risk

By using Homebase to discover, contact, or engage with any Provider, you acknowledge and agree that:

Any agreement, contract, or arrangement you make with a Provider is solely between you and that Provider
Homebase is not a party to any transaction, agreement, or relationship between you and any Provider
You assume all risk associated with engaging with any Provider, including but not limited to physical injury, property damage, emotional distress, or any other harm
Providers are independent third parties and are not employees, agents, contractors, or representatives of Homebase
The accuracy, completeness, and truthfulness of Provider listings is the sole responsibility of the Provider

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

HOMEBASE, MIGHTY JO LLC, AND ILLUMINATION + INSPIRATION SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR YOUR INTERACTIONS WITH ANY PROVIDER
THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF PROFITS, EMOTIONAL DISTRESS, OR ANY OTHER DAMAGES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

Indemnification

You agree to indemnify, defend, and hold harmless Homebase, Mighty Jo LLC, Illumination + Inspiration, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the platform; (b) your interactions with any Provider; (c) any breach of these Terms by you; (d) any violation of applicable law by you; or (e) any claim by a third party arising from your conduct or your use of the platform.

Disclaimer of Warranties

HOMEBASE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE PLATFORM, INCLUDING PROVIDER LISTINGS.

Acceptable Use

You agree not to:

Share content that is harmful, abusive, or illegal
Attempt to access other users' accounts or data
Use automated systems to scrape or collect data
Interfere with the platform's operation

Account Termination

You can delete your account at any time. We may suspend or terminate accounts that violate these terms. Before termination, we'll give you the opportunity to export your data when possible.

Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Homebase shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Florida, and the arbitrator's decision shall be final and binding. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Florida.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Changes to Terms

We may update these terms occasionally. We'll notify you of significant changes via email or through the platform. Continued use after changes means you accept the new terms.
